Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Kura Digital Foundation website, the Kura Business Directory, and related services (collectively, the "Services"), operated by Kura Digital Foundation NPC ("Kura", "we", "us" or "our"). By accessing or using the Services, you agree to these Terms.
1. Description of Services
Kura provides a verified directory of Black-owned businesses, free digital skills workshops for high school learners, and related informational content, in furtherance of our mission as a registered nonprofit organisation.
2. Eligibility
The Kura Business Directory is open to businesses that are majority Black-owned (51% or more), registered with CIPC, and actively trading in South Africa. Kura reserves the right to decline or remove any listing that does not meet these criteria or that contains false or misleading information.
3. Your Responsibilities
- Provide accurate and current information when registering a business, school, or making an enquiry;
- Keep your listing information up to date;
- Use the Services only for lawful purposes and not to misrepresent your business, credentials, or B-BBEE status.
4. Directory Listings and Verification
Kura takes reasonable steps to verify listed businesses against CIPC and SARS records at the time of listing. Verification reflects the information available to us at that time and does not constitute an ongoing guarantee of a business's status, quality, or performance. Businesses are responsible for keeping their own information accurate.
5. Intellectual Property
The Kura name, logo, seal mark, and website content (excluding user-submitted business listings) are the property of Kura Digital Foundation NPC and may not be copied, reproduced, or used without our prior written consent. By submitting content to your directory listing, you grant Kura a non-exclusive licence to display that content on our platform and in related promotional or reporting materials.
6. Third-Party Links
Our website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of those sites.
7. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis. Kura makes no warranties, express or implied, regarding the accuracy, completeness, or reliability of any content on the Services, to the fullest extent permitted by law.
8. Limitation of Liability
To the fullest extent permitted by law, Kura Digital Foundation NPC shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of, or inability to use, the Services.
9. Termination
We reserve the right to suspend or remove access to the Services, or to remove a directory listing, at our discretion, including where these Terms are breached.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa, and any disputes will be subject to the jurisdiction of the South African courts.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
